Patent fees

All fees are in New Zealand Dollars (NZD). The fees listed below do not include GST. GST (15%) applies to all fees where the applicant or requestor is in New Zealand.

Excess claims fee

Excess claims fee for examination of a patent application with 30 or more claims

  • This applies only to patent applications where examination is requested on or after 13 February 2020
$120 for each 5th claim over 25


The total excess claims fee payable for a patent application will be calculated based on the maximum number of claims contained in the complete specification during the examination process. This fee will be charged when the patent application has been accepted, and must be paid before the application can proceed to grant.

Renewal fees whose three-month payment period commences on or after 13 February 2020 are subject to the above fees.

Late payments made on or after 13 February 2020 are subject to the above late payment penalty fee.

Refund of fees

A refund will be considered where required or permitted by Regulation 149 of the Patents Regulations 2014.

Refunds will not be provided in the following circumstances:

  • GST amounts are not eligible as separate refunds from their applicable fees. Where the applicant or requestor is in New Zealand, the Office will assume that GST is payable by the applicant or requestor.
  • Refunds will not be processed once a filing has been receipted and work has commenced on the filing.

Request a refund

Request a refund in writing and include the following information:

  • receipt date
  • receipt number
  • amount you are requesting be refunded
  • reason for refund
  • name of person/organisation the refund is to be paid to.

If you have paid the fees using our direct debit system, the refund will show as an adjustment on your next direct debit statement.

If you paid the fees by any other method, your refund will normally be direct credited into your bank account.
