Offering to surrender a patent
Surrendering of patents
Patents owners may offer to surrender a granted Patent at any time using the online system. Prior to granting of a Patent an application may be withdrawn – see Withdrawing a Patent.
The offer to surrender a Patent will be advertised in the next journal for an opposition period of one month. Electronic confirmation of successfully surrendered Patents will be communicated to the owner at the end of the opposition period. Oppositions to the surrendering of the Patent will also be communicated in the same way.
If the Patent is a Main Patent, with associated Patents of Addition, then these will also be surrendered at the same time as the main patent. Patent owners should request that these be made Independent Patents prior to offering to surrender if they wish to retain them – via the Amend Patent online facility.
