New Hearings guidance on alternative dispute resolution

IPONZ has released new guidelines on alternative dispute resolution, an alternative method of resolving IP disputes.

We have recently added new guidance on Alternative Dispute Resolution (ADR) for Trade Mark and Patents disputes.

ADR provides an alternative method by which parties can resolve intellectual property disputes, rather than go through a proceeding. Under ADR procedures, the parties choose a mediator or arbitrator who has legal and technical expertise in intellectual property. The mediator / arbitrator then presides over a forum where the dispute can be resolved.

Parties may currently contact the World Intellectual Property Organization Arbitration and Mediation Center to organise an ADR proceeding, or they may contact an independent mediator or arbitrator who is based in New Zealand or Australia.
